The Vice Chancellor of the University of Mkar, Benue State, Professor Zacharys Anger Gundu, has asked an FCT High Court to strike out a ₦100.5 billion defamation lawsuit filed against him by the Nasarawa State Government and Governor Abdullahi Sule. The request was made through a preliminary objection submitted by his legal team.
The objection, filed by his counsel led by senior advocate Sebastian Hon, SAN, challenges the validity of the suit and urges the court to decline jurisdiction. Gundu described the case as frivolous and an abuse of the judicial process, insisting that it should not be allowed to proceed to trial.
According to the filing, the claimants allegedly failed to meet a mandatory legal requirement before instituting the suit. The objection stated that the originating processes did not comply with Order 2 Rule 8 of the FCT High Court Civil Procedure Rules, 2025, which is required for a case of this nature to be valid.
Gundu argued that this procedural lapse makes the entire suit defective and liable to be struck out. He therefore urged the court to dismiss the matter outright, stressing that failure to follow due process undermines the integrity of judicial proceedings.
