A human rights lawyer, Barrister Victor Giwa, has written to the Chief Judge of the Federal Capital Territory (FCT) High Court, Justice Husseini Baba-Yusuf, claiming he cannot get justice in his ongoing trial. Giwa, facing prosecution before Justice Jude Onwuegbuzie, requested that his case be reassigned to another judge, alleging bias and partiality from both the presiding judge and the nominal complainant, Asabe Waziri.
In a letter dated January 14, 2026, Giwa stated that previous complaints and applications for recusal had gone unanswered. He claimed that Justice Onwuegbuzie had already taken a position favoring the prosecution and consistently refused to hear his motions, while also allegedly threatening him in open court. Giwa said he had lost confidence in receiving a fair trial in the current court.
The lawyer further alleged that Asabe Waziri maintains close contact with the court and benefits from heavy police protection during proceedings. Giwa argued that such preferential treatment created an environment where he could not expect impartiality. He cited multiple instances, including a court session on January 12, 2026, which he believes was deliberately arranged to favor the prosecution’s attempts to revoke his bail.
The charges against Giwa and his co-accused, Bukola Ibitade, relate to alleged forgery of a Senior Advocate of Nigeria’s (SAN) letterhead. However, the SAN, Chief Awa Kalu, denied filing any complaint, stating in a letter to the Inspector General of Police that Giwa and Ibitade did not forge his letterhead. Despite this clarification, police pressed forward with the prosecution, prompting Giwa to appeal to the FCT Chief Judge for reassignment of his case.
