The leader of the banned Indigenous People of Biafra (IPOB), Nnamdi Kanu, has asked the Chief Justice of Nigeria (CJN), Justice Kudirat Kekere-Ekun, to assign his case to a different judge.
His legal team, led by Aloy Ejimakor, sent a letter explaining that the current judge, Justice Binta Nyako, had already stepped down from the case after Kanu accused her of bias.
Ejimakor stated that once a judge recuses themselves, they cannot continue handling the case. He compared the situation to a decision on jurisdiction, saying it should not be reversed.
Kanu is facing seven charges related to terrorism, filed by the Federal Government. His lawyers warned that keeping the case with a judge who had already stepped down could damage public trust in the judiciary.
Ejimakor also revealed that Kanu had filed a formal complaint against Justice Nyako with the National Judicial Council on January 14, 2025, and the case was still pending.
He urged the CJN to take action to ensure a fair trial by moving the case to another judge in Abuja or transferring it to a court in the South-East.
