The Lagos State Special Offences Court in Ikeja has discharged and acquitted former Minister of Aviation, Femi Fani-Kayode, of a 12-count charge related to forging a medical report.
The judgment, delivered on February 4 by Justice Olubunmi Abike-Fadipe, stated that the Economic and Financial Crimes Commission (EFCC) lacked the constitutional power to prosecute him for the alleged offence.
The EFCC had accused Fani-Kayode of obtaining a fake medical report from Dr. Ogieva Oziegbe. According to the agency, the report was allegedly used in his ongoing trial before Justice Daniel Osiagor at the Federal High Court for money laundering charges.
The anti-graft agency claimed that on October 11, 2021, in Kubwa, Abuja, Fani-Kayode conspired with Dr. Oziegbe to issue a false medical document, making it appear as if it was from Kubwa General Hospital.
The EFCC further argued that forging and using a fake document violated Section 369 of the Criminal Law of Lagos State 2015.
However, Fani-Kayode denied all allegations and pleaded not guilty.
While delivering the judgment, Justice Abike-Fadipe ruled that the case was not related to economic crimes, and the evidence presented did not directly link Fani-Kayode to the offence.
Due to this, the court ruled in his favor and dismissed the charges.
This ruling marks a legal victory for Fani-Kayode, who has been facing multiple court cases in recent years.
His legal team has welcomed the verdict, maintaining that the allegations against him were baseless.
