2027: Reps proposed 2 years imprisonment for dual party membership stirs controversy

The House of Representatives has sparked controversy by proposing a fresh amendment to the 2026 Electoral Act that imposes a N10 million fine or two years imprisonment for anyone holding membership in more than one political party. The amendment targets dual party membership, mandating the loss of membership in all parties until regularisation is completed.

Sponsored by House Leader Julius Ihonvbere, the legislation states that anyone knowingly registered in multiple parties commits an offense, punishable by fine, imprisonment, or both. Supporters argue it prevents fraudulent representation and ensures politicians commit to one party.

However, critics, including House Committee on University Education Chairman Abubakar Fulata, say the amendment conflicts with Section 40 of the 1999 Constitution, which guarantees freedom of association. Deputy Speaker Benjamin Kalu insists that individuals should align with a single party that reflects their ideology.

Opposition leaders, notably SDP’s Prince Adewole Adebayo, condemn the move as unconstitutional and a threat to democratic freedoms. Adebayo emphasizes that while election sponsorship requires one party, membership in multiple parties should remain legal, calling the amendment “legislative lynching.”

Analysts argue the ruling APC fears defections amid economic hardship and insecurity, and the law seeks to prevent internal instability. Critics also accuse lawmakers of double standards, noting some who support the amendment have switched parties in the past.

Despite APC’s dominance in governance, opposition voices stress that electoral victories do not necessarily reflect public approval. They argue that Nigerians, not political maneuvering, will have the final say in upcoming elections, warning that such amendments undermine democratic fairness.
