Customer Sues Opay, Says Account Restriction Led To Father’s Death

A Nigerian trader, Moses King, has filed a lawsuit against Opay Digital Service Limited at the Federal High Court in Lagos, accusing the company of unlawfully restricting his bank account. He claimed that the action had tragic consequences, alleging that it prevented him from paying his father’s medical bills. The case was brought under the Fundamental Rights Enforcement Procedure in line with the 1999 Constitution.

According to court documents, King said his account was placed on a Post No Debit (PND) restriction from September 17, 2025, to December 9, 2025. He argued that the restriction was done without a valid court order. The trader is asking the court to declare the action illegal, unconstitutional, and a violation of his fundamental rights. He also wants the company to publish a public apology in two national newspapers.

King further claimed that he had N500,000 in the account, which he intended to use for his father’s hospital treatment. He alleged that the inability to access the funds led to his father’s death. In addition, he is demanding N50 million as exemplary damages. The applicant maintained that he operates the account for legitimate business transactions and has never been involved in fraud.

The suit, marked FHC/L/CS/178/2026, is scheduled for hearing on March 2 before Justice Daniel Osiagor. Opay is yet to file a formal response to the claims, although it has reportedly been served with the court papers. The outcome of the case is expected to draw attention to the rights of customers in Nigeria’s growing fintech sector.
