The Attorney-General of the Federation (AGF) and Minister of Justice, Prince Lateef Fagbemi, SAN, has taken over the prosecution of the alleged fraud case filed by the ICPC against Prof. Mike Ozekhome, SAN. The High Court of the Federal Capital Territory approved the move, allowing the AGF to review the case file. As a result, the arraignment earlier fixed for Monday has been shifted to February 24.
During the court session, the AGF explained that the takeover was necessary to allow his office study the case properly and make an informed decision. The Director of Public Prosecution of the Federation, Mr Rotimi Oyedepo, SAN, formally announced the AGF’s appearance and informed the court that the action was taken under Section 174 of the 1999 Constitution, which empowers the AGF to take over criminal prosecutions.
Oyedepo said the decision was guided by public interest and the need to ensure fairness, due process and confidence in the justice system. He added that the AGF’s office would work with the ICPC to ensure the case meets the highest legal standards, while also protecting the rights of the defendant. According to him, inter-agency cooperation in the fight against corruption was a key reason for the move.
The ICPC did not oppose the takeover and assured the court of its full cooperation, since it handled the investigation. Lawyers to Prof. Ozekhome, led by former AGF Kanu Agabi, SAN, also agreed to the adjournment. Justice Peter Kekemeke then fixed February 24 for the next court date, when the arraignment is expected to take place.
