‘Case overtaken by events’ – Osun withdraws suit against CBN, AGF over withheld LG funds

The Osun State Government has withdrawn its lawsuit against the Central Bank of Nigeria (CBN) and the Accountant-General of the Federation (AGF) over the alleged release of withheld local government allocations to “court-sacked” chairmen and councillors elected during the tenure of former Governor Adegboyega Oyetola.

During Friday’s court proceedings, Musibau Adetumbi (SAN), counsel to the Osun Attorney-General, informed the Federal High Court that the case had become irrelevant since the funds in question had already been disbursed by the defendants despite an existing court order. He said the primary goal of the lawsuit—to safeguard the money—had been defeated. “The money has left the CBN. So, what are we still arguing?” Adetumbi stated.

While the CBN’s counsel, Dr. Muritala Abdulrasheed (SAN), and the AGF’s counsel, Tajudeen Oladoja (SAN) did not oppose the withdrawal, they faulted the affidavit of facts filed by the plaintiff, describing some of its contents as misleading. They requested that the court strike out certain paragraphs they claimed referred to individuals not involved in the case. The AGF’s lawyer also sought a cost of ₦10 million against the plaintiff for wasting the court’s time.

Responding, Adetumbi maintained that under the Federal High Court Rules, a notice of discontinuance does not attract costs and that the defendants’ request was baseless. He stressed that since the funds had already been moved, continuing the case would amount to “an academic exercise.”

After hearing arguments from all parties, Justice Emeka Nwite adjourned the matter until October 29, 2025, for a ruling on the plaintiff’s application for discontinuance and other pending motions. Speaking to journalists, Adetumbi reiterated that the case was withdrawn because “the purpose of the suit—to protect the money—no longer exists.”
