EFCC Requests Court to Proceed with Yahaya Bello’s Arraignment in His Absence

The Economic and Financial Crimes Commission (EFCC) has asked the Federal High Court in Maitama, Abuja, to proceed with the trial of Yahaya Bello, the former governor of Kogi State, even if he isn’t present. On October 30, the EFCC’s lead counsel, Kemi Pinheiro, argued that Bello’s continued absence should not hold back justice.

“A court can never demonstrate helplessness.That would be an indication of anarchy and society is based on the rule of law. The court demonstrating helplessness will negate the basis of the rule of law,” he said.

Yahaya Bello is accused of laundering N80.2 billion, facing 19 charges related to these allegations. However, he has missed six court summons for his arraignment. According to Pinheiro, Bello’s failure to appear seems intentional and aims to disrupt the trial process.

To prevent further delays, Pinheiro suggested that the court enter a “not guilty” plea on Bello’s behalf. He highlighted that under the Administration of Criminal Justice Act (ACJA), it’s not mandatory for a defendant to be physically present for arraignment if their absence appears deliberate. Allowing such delays, Pinheiro argued, could undermine the rule of law, which is essential for an orderly society.

“A criminal trial must not be held hostage, truncated or frustrated by a defendant’s refusal to engage the process. Justice is a three-way street: justice to the defendant, justice to the prosecution who has assembled witnesses and justice to the society”.

The EFCC’s stance emphasizes that a defendant shouldn’t evade justice by avoiding court appearances. By pushing for Bello’s trial to proceed in absentia, the EFCC hopes to prevent any tactics aimed at stalling the process.

“The right to plead guilty or not guilty is a right that can be waived by the defendant,” adding that Bello’s absence should not impede the case.
