In a recent ruling, the Appeal Court in Port Harcourt has dismissed an appeal filed by His Highness Anabs Sara-Igbe and nine other plaintiffs against President Bola Tinubu, Governor Siminalayi Fubara, and several others. The case was originally brought before the Rivers State High Court, led by Justice Chinwendu Nworgu.
The plaintiffs had challenged the legality of President Tinubu instructing Governor Fubara to resubmit the 2024 budget to 24 lawmakers, even though their seats had been declared vacant. The High Court had previously dismissed the case, stating it lacked jurisdiction to handle the matter.
The Appeal Court, headed by Justice Elfreda Oluwayamisi-Dawodu, upheld this decision, agreeing that the state High Court was not the right forum for the case and that the plaintiffs’ actions were essentially academic exercises.
