Former South African soldier sentenced to life imprisonment for r@pe and deliberately infecting his girlfriend with HIV

In a shocking case from South Africa, Leon Santos Conga, a former member of the South African National Defence Force, has been sentenced to life in prison for the rape of his girlfriend. The Pretoria Magistrates’ Court not only held him accountable for this heinous crime but also for deliberately infecting her with HIV. This case highlights the serious issue of sexual violence and its devastating consequences.

Conga and his girlfriend were in a relationship for four months, from December 16, 2016, to April 2017. Before they started dating, the victim had tested negative for HIV on December 1, 2016. Concerned about her health, she raised the topic of HIV when their relationship began. Conga falsely claimed he was HIV negative, asserting that he was healthy enough to be deployed overseas. They agreed on a “no condom, no sex” rule, but during two intimate encounters, Conga removed the condom without her knowledge.

After feeling unwell, the victim went for an HIV test, which confirmed she was positive. When she confronted Conga, he denied any wrongdoing. The victim reported the incident to the police in May 2017, but it wasn’t until July 9 that an investigation began.

The case faced several challenges. 2018, it was dismissed due to insufficient evidence. However, further investigation and new evidence from the SANDF led to the case being reopened on August 21, 2021. During the trial, Conga claimed that the victim had removed the condom and denied infecting her.

To strengthen the case, the prosecution brought in HIV expert Professor Terresa Russouw, who explained the effects of HIV and supported the attempted murder charge. Evidence revealed that Conga had tested positive for HIV as early as October 8, 2007, indicating he was aware of his condition when he had unprotected sex with the victim.

During the sentencing phase, the victim shared her painful experience. Advocate Emile Van der Merwe emphasized the emotional scars left by Conga’s actions and the constant reminder of her HIV status. She expressed anxiety about the possibility of infecting future partners or children.

In a strong statement, the Regional Magistrate, Ntlati, noted Conga’s lack of remorse and the severity of his crimes. The court sentenced him to life imprisonment for rape and an additional 10 years for attempted murder, with both sentences running concurrently. This decision underscores the seriousness with which the legal system views sexual violence and its effects on victims.
